Judgement delivered on May 28th 1986

Brief

  • Finding of fact
  • Declaration of title
  • Jurisdiction
  • Possession and ownership

Facts

The Plaintiffs/Respondents commenced an action at a Grade "B" Customary Court claiming ownership and declaration of title to a piece of land. They based their root of title on a grant made to them by the Oshun of Ogbomoso about 200 years previously, and acts of possession of the said land.

The defendants/appellants based their root of title on settlement by their ancestors.

The President of the Customary Court found that the Plaintiffs/Respondents had proved their claim both on the ground of grant as well as on the ground of possession and acts of ownership. A decision which was supported by the appellate High Court and the Court of Appeal.
